I. Definitions

1. Organizer - Rokezzz Bogumił Skoczylas company with headquarters in Biskupice Zabaryczne 169, 63-510 Mikstat, NIP: 514 034 54 28, REGON: 369 135 731.
2. Participant - a natural person conducting business or a legal entity in the form of a partnership or a corporation that has established cooperation with the Organizer in order to promote and recommend the Organizer's services in exchange for agreed benefits.
3. Affiliate Program - a program of cooperation between the Organizer and the Participant aimed at achieving material and marketing benefits for both parties.
4. Terms - this document defining the rules of operation of the Affiliate Program, including the rights and obligations of the Organizer and the Participants, the conditions of participation and the rules for calculating commissions.
5. Customer - an entity recommended to the Organizer by a Participant who was interested in the Organizer's offer.

II. General Provisions

1. Niniejszy Regulamin określa zasady uczestnictwa w Programie Partnerskim.
2. Program Partnerski umożliwia Uczestnikom otrzymywanie prowizji i innych korzyści za polecanie usług tworzenia stron, sklepów internetowych, marketingu oraz pozycjonowania realizowanych przez Organizatora.
3. Regulamin ma charakter informacyjny i nie stanowi umowy w rozumienia przepisów prawa cywilnego. Szczegółowe zasady współpracy zostaną określone w indywidualnej umowie partnerskiej zawieranej pomiędzy Organizatorem a Uczestnikiem.

III. Scope of the program

1. The Affiliate Program includes referrals from customers who have not previously used the Organizer's services.
2. The Affiliate Program applies only to website development services, online store development, marketing and SEO.
3. The Partner Program does not include:
   1. Additional functionality to existing projects,
   2. Expansion of already made websites or stores without considering positioning and marketing,
   3. services not listed in Section 2 of this paragraph, including: domains, email addresses, SSL certificates, hosting, servers, technical support and external subscriptions and packages,
   4. entities that use or have already used the services of the Organizer.
4. The Organizer may expand the scope of the Partner Program in the future.

IV. Participants of the Partner Program

1. A participant in the Affiliate Program may be a natural person conducting business or a legal entity in the form of a partnership or a corporation.
2. The condition for joining the Partner Program is the signing of the Partner Agreement.
3. Successful recommendation of the Organizer's services by the Participant is not a condition for being a Participant of the Affiliate Program.

V. Customer Referral Rules

1. Before enrolling a Client, the Participant should make sure that the Client consents to be contacted by the Organizer - the process must take place legally, respecting privacy and data protection regulations, in particular RODO.
2. To report a Customer, the Participant provides only the data necessary for the Organizer to conduct further sales stages:
   1. The company's TIN or first and last name in the case of individuals,
   2. form of contact (e-mail address and/or telephone number),
   3. The organizer does not require additional personal information at this stage.
3. After receiving the application, the Organizer contacts the customer, presents the service offer and conducts the entire sales process.
4. The order is considered effective when all conditions are met:
   1. Signing a contract with a potential customer,
   2. posting of the first payment from the customer under the agreement in the above subsection.

VI. Affiliate levels and commissions

Bronze Level

• Requirements: none - basic level
• Commission: 5% of the total amount agreed on the contract
• Other benefits:
• Adding the Organizer to the list of partners

Silver Level

• Requirements: 2 successful referrals per year
• Commission: 6% of the total amount agreed on the contract
• Other benefits:
• All the benefits of the Bronze level,
• Priority of email contact on matters related to the Partner Program,
• Presence in the list of partners on the Organizer's website,
• Physical marketing materials provided free of charge by the Organizer,
• Partner discount of 5% on the Participant's own projects and services implemented by the Organizer.

Gold Level

• Requirements: 5 successful referrals during the year
• Commission: 8% of the total amount agreed on the contract
• Other benefits:
• All the benefits of the Silver level,
• Priority of telephone contact on matters related to the Partner Program,
• Ability to post one publication per year on the Organizer's blog created jointly by the Participant and the Organizer,
• A one-time entry in the Organizer's Social Media,
• Partner discount of 7% on the Participant's own projects and services implemented by the Organizer.

Diamond Level

• Requirements: 10 successful referrals during the year
• Commission: 10% of the total amount agreed on the contract
• Other benefits:
• All Gold Level Benefits,
• Dedicated contact person for matters related to the Partner Program,
• The possibility of posting a second publication per year on the Organizer's blog created together by the Participant and the Organizer,
• Invitations to events organized by the Organizer,
• Active recommendation of the Participant's company by the Organizer,
• Partner discount of 10% on the Participant's own projects and services implemented by the Organizer.

VII. Charge and payment of commissions

1. The commission is charged after the contract is signed and the deposit from the client is credited.
2. The commission is calculated on the basis of the amount to be placed in the contract between the Organizer and the customer.
3. The amount of commission depends on the Participant's partner level in effect on the date of signing the contract with the customer.
4. The participant can collect the commission in two forms:
1. cash payment to the Participant's account specified in the agreement,
2. discount for the website or online store at the Organizer with a value of twice the earned commission.
5. The participant himself chooses how and when to collect the commission. However, this deadline may not exceed one year from its accrual.
6. Settlements in the form of monetary payment shall be made on the basis of invoices issued by the Participant to the Organizer in accordance with applicable laws.

VIII. Responsibilities of the Participant

1. The participant undertakes to provide referrals in a professional, legal manner and with respect for the privacy of customers.
2. The Participant is not authorized to enter into contracts or make statements on behalf of the Organizer, unless the parties agree otherwise.
3. The Participant should inform the Customer that the Organizer will contact him, unless the Customer decides otherwise.
4. Each Participant agrees to be contacted by the Organizer in order to present new offers, promotions, information about the Affiliate Program and other marketing activities aimed at Participants and their referred customers. Contact may be made by e-mail or telephone.

IX. Fair practices, prohibition of misleading activities and anti-advertising

1. Participant agrees to conduct promotional, sales and informational activities regarding the Partner Program in a reliable, honest manner and in accordance with good business practices.
2. Prohibited:
1. Making promises, guarantees or declarations to customers that the Organizer has not confirmed or provided for in its offer,
2. Providing false information about the Organizer's services, prices, implementation time or scope of the project,
3. Use of pressure, aggressive sales or incentives that may mislead the customer,
4. Performing marketing or sales activities that could damage the good name, brand or reputation of the Organizer,
5. publishing or transmitting content that constitutes anti-advertising or that may harm the perception of the Organizer's services.
3. Participant agrees not to undertake activities that could cause image, financial or reputational damage to the Organizer, including the use of the Affiliate Program for illegal purposes or contrary to the Affiliate Program rules.
4. In the event that fraudulent activities mentioned above are found, the Organizer has the right:
1. Stop the accrual and payment of commissions,
2. lower the partner level of the Participant,
3. terminate cooperation with immediate effect,
4. refuse to settle referrals obtained in violation of the regulations.
5. All activities of the Participant must be conducted in compliance with the law, good market practices and with concern for customer relations.

X. Responsibilities of the Organizer

1. The promoter contacts the referred customer, presents the offer, conducts the sales process and after-sales service.
2. The Organizer provides Silver level and above Participants with relevant marketing materials.
3. The organizer maintains a fair and transparent accounting of commissions.
4. The Organizer agrees to provide the Participant with access to all additional benefits of its partner level.

XI. Additional provisions

1. The Organizer reserves the right to refuse to sign the Affiliate Agreement if it believes that the cooperation could violate the rules of the Affiliate Program or the interests of the Organizer, the Participant or the Organizer's customers.
2. The Organizer has the right to update the Regulations. Changes will be published on the website and communicated to Participants by e-mail.
3. Continued use of the Affiliate Program after the amendment of the Terms and Conditions implies acceptance of the same.

XII. Termination of participation in the Partner Program

1. Participant may terminate participation in the Partner Program by sending a written or email resignation with immediate effect.
2. The Organizer may terminate cooperation with the Participant by sending a written or emailed resignation with one month's notice.
3. The Organizer may terminate cooperation with the Participant in case of violation of the Affiliate Program rules with immediate effect.
4. Commissions due for referrals completed before the termination date are settled in accordance with the Regulations.
